Is It Legal to Put Up a Trail Camera? Rules to Know

In many parts of the United States, you can put up a trail camera on property you own or have permission to use, but the rules depend on your location and how you use it. Before mounting one, review applicable state and local laws, property rules, and any regulations governing public land or hunting.
On your own property, choose a location that monitors your land without deliberately capturing areas where neighbors or visitors reasonably expect privacy, such as windows, bathrooms, or changing areas. On someone else’s property, get the owner’s or authorized manager’s permission before entering or installing a camera; permission to hunt or hike does not necessarily include permission to leave equipment behind.

Public access does not automatically mean you can install a camera: the managing agency may restrict unattended equipment, mounting methods, placement periods, or cameras altogether. Some states also limit trail-camera use for hunting or scouting, particularly during certain seasons or when images are transmitted remotely, so check both wildlife regulations and the specific land manager’s rules before setting one out.
Audio recording can be subject to separate consent laws, so consider disabling sound if your device offers that option and you have not confirmed the rules for your situation. We also recommend positioning the camera carefully, limiting access to recordings, and removing it when permission or an allowed placement period ends; for a different type of compact camera, our 4K Mini Action Camera with WiFi, 270° Rotatable Lens & Waterproof Case is featured in our guide.
It can be illegal to enter someone else’s property or install a camera there without permission, depending on the circumstances and local law. Ask the owner or authorized manager first, and agree on where the camera can go and when it must be removed.
